This Privacy Notice explains how Archedata, Inc. (“Archedata”, “we”, “us” or “our”) collects, uses, shares and protects personal information when you visit archedata.io (the “Site”) or ask us for a demonstration of Kairos, and the choices and rights available to you.
Who we are
Archedata, Inc. is a data management software and services company headquartered at 104 West 40th Street, Suite 400, New York, NY 10018, United States. For the purposes of the EU and UK General Data Protection Regulations, Archedata, Inc. is the controller of the personal information described in this notice.
Scope of this notice
This notice applies to personal information we collect through the Site, including the “Request a demo” form, and through related correspondence with us. It does not apply to information that our customers submit to or process in the Kairos platform; that information is handled under the agreements we have with each customer. It also does not apply to websites operated by others.
Information we collect
Information you give us. When you request a demo, we collect your name, work email address and firm, and anything you choose to include in the optional notes field. If you email or call us, we receive the information you provide in that communication. Please do not include sensitive personal information in the notes field.
Information collected automatically. When you visit the Site, our hosting and content delivery provider processes standard technical information, such as your IP address, browser type, the pages you request and the date and time of each request, as necessary to deliver the Site and keep it secure. We do not use analytics tools, and we do not use this technical information to identify or profile visitors.
Fonts. The Site loads its typefaces from Google Fonts. When it does, your browser connects to Google’s servers, which receive your IP address and browser information.
How we use information
We use personal information to:
- respond to your demo request and arrange and hold the conversation, including follow-up correspondence about that request;
- operate, maintain and secure the Site, and prevent misuse; and
- comply with legal and regulatory obligations, and establish, exercise or defend legal claims.
We use the information you submit through the demo form only for these purposes. We do not use it to send you marketing communications, and we do not use it for automated decision-making or profiling. If you would like to hear from us about our products and services, we will ask for your consent separately.
How we share information
We do not sell personal information, and we do not share it for cross-context behavioral advertising. We disclose personal information only as follows:
- Service providers that process it on our behalf and under our instructions: Amazon Web Services (hosting, content delivery, and delivery of demo-request emails through Amazon Simple Email Service) and Microsoft (an internal Microsoft Teams notification to our team when a demo request arrives).
- Google, when your browser loads fonts from Google Fonts, as described above. Google’s use of that information is governed by Google’s own privacy policy.
- Professional advisers, such as lawyers, auditors and insurers, where necessary.
- Authorities and others where required by law, regulation or legal process, or where necessary to protect the rights, property or safety of Archedata, our clients or others.
- Business transfers: in connection with a merger, acquisition, financing or sale of all or part of our business, subject to appropriate confidentiality protections.
Cookies and tracking technologies
The Site does not set cookies and does not use analytics, advertising, social media or other tracking technologies. Because we do not track visitors across websites, the Site does not respond differently to “Do Not Track” signals. If your browser sends a Global Privacy Control signal, we treat it as a request to opt out of the sale or sharing of your personal information, which we do not do in any case.
Retention
We keep demo-request information and related correspondence for as long as needed to respond to you and to maintain a record of our business communications, and afterwards only for as long as required or permitted by law, regulation or our record-keeping obligations. When we no longer need it, we delete it or de-identify it.
Security
We use reasonable administrative, technical and physical safeguards designed to protect personal information. The Site is served only over encrypted HTTPS connections, and demo requests are delivered to a restricted business mailbox rather than stored in a website database. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.
International transfers
Archedata is based in the United States, and we and our service providers process personal information in the United States. If you are located outside the United States, including in the European Economic Area or the United Kingdom, your information will be transferred to and processed in the United States, where data protection laws may differ from those in your country. Where applicable law requires, we put appropriate safeguards in place for these transfers.
Your choices and rights
Submitting the demo form is voluntary. You may ask us to access, correct or delete the personal information we hold about you by contacting us at info@archedata.io. Depending on where you live, you may have additional rights, described below. We will not discriminate against you for exercising any of your rights.
California residents
This section applies to residents of California and supplements this notice as required by the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the “CCPA”).
Personal information we collect and disclose
In the preceding 12 months we have collected the following categories of personal information:
- Identifiers, such as your name, work email address and IP address;
- Professional information, such as your firm and anything you include in the notes field; and
- Internet or other electronic network activity, such as the technical information processed to deliver the Site.
We collect this information directly from you and automatically from your browser or device, for the purposes described in “How we use information”. We have disclosed each of these categories for a business purpose to the service providers and other recipients described in “How we share information”. We have not sold or shared personal information in the preceding 12 months, and we have no actual knowledge of selling or sharing the personal information of consumers under 16. We do not collect or use sensitive personal information for purposes that would give rise to a right to limit its use. We keep personal information as described in “Retention”.
Your California rights
Subject to certain exceptions, you have the right to know what personal information we have collected about you and to access it; to request that we delete it; to request that we correct inaccurate personal information; to opt out of the sale or sharing of personal information (which we do not do); and not to receive discriminatory treatment for exercising these rights.
To make a request, email info@archedata.io with the subject “California privacy request”. We will verify your request by matching the information you provide with the information we hold. You may use an authorized agent, who must provide your written permission, and we may still ask you to verify your identity directly. We will respond within the time required by law.
EEA and UK residents
If you are in the European Economic Area or the United Kingdom, the following also applies. Archedata, Inc. is the controller of your personal information.
Legal bases
- Steps at your request: to respond to your demo request before any contract is entered into;
- Legitimate interests: to respond to business inquiries, maintain business correspondence, and operate and secure the Site, where those interests are not overridden by your rights;
- Legal obligation: to comply with laws and regulations that apply to us; and
- Consent: where we ask for it, which you may withdraw at any time without affecting processing before withdrawal.
Your rights
You have the right to access, rectify or erase your personal information; to restrict or object to its processing, including processing based on legitimate interests; and to data portability. To exercise these rights, contact us at info@archedata.io. You also have the right to lodge a complaint with a data protection supervisory authority in the country where you live or work or where you believe an infringement occurred; in the United Kingdom, this is the Information Commissioner’s Office.
Children
The Site is intended for business professionals and is not directed to children under 16. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will delete it.
Links to other websites
If the Site links to websites operated by others, those websites are governed by their own privacy notices, and we are not responsible for their practices.
Changes to this notice
We may update this notice from time to time. When we do, we will change the “Last updated” date above and, where the changes are significant, take any additional steps required by law.
